1. Introduction
1. Groupe Lucien Barrière SAS runs the Hôtels Barrière booking site, www.hotelsbarriere.com. This website presents Barrière hotels run by subsidiaries of Groupe Lucien Barrière or companies affiliated with the Barrière brand. This website allows for the booking of rooms at Hotels belonging to Groupe Barrière.
2. The Customer declares they have obtained from Groupe Lucien Barrière and Barrière hotels all the necessary information for them to make a selection and a booking on this website.
THESE SALES TERMS AND CONDITIONS APPLY TO ALL BOOKINGS MADE AT HOTELS BARRIERE BY AN INDIVIDUAL CUSTOMER ON THE GROUPE LUCIEN BARRIERE WEBSITE.
3. All bookings made on the site www.hotelsbarriere.com assume the consultation and unconditional acceptance of these terms and conditions, as well as the sales conditions for the rate booked specifically mentioned in the description of the rate selected at the time of booking.
4. The Customer must confirm by ticking the box, to have acknowledged and accepted these terms and conditions and the sales conditions for the rate booked before committing to their booking; no reservations are possible without such agreement.
5. The Customer can save and edit these terms and conditions by using the standard tools on their browser or computer.
6. The following information is posted on the site:
• the legal notice that provides precise identification of Groupe Lucien Barrière, indicating the company name, head office and its individual VAT identification number,
• the basic features of the accommodation offered by Hôtels Barrière,
• the supplementary and optional services available,
• the prices inclusive of tax;
• the sales conditions at the time of booking,
• payment terms;
• the sales terms and conditions,
• the validity period for the offer and the price of it.
7. Prior to booking, the Customer declares that this reservation is for personal requirements. As a consumer, the Customer has specific rights, which will be challenged if the services booked are not for personal use.
8. All the information available on the www.hotelsbarriere.com site is in French, as well as other languages.
9. The Customer declares that they have full legal authority to commit to these terms and conditions.

2. Definitions
Hereinafter, the below terms have the following meaning:
"acknowledgement of receipt": email sent to the Customer by www.hotelsbarriere.com to advise them that their booking has been taken into account and summarising the services included with their booking,
"booking form": See Booking enquiry
"booking confirmation": an electronic document summarising the details of the services booked by the Customer on the site www.hotelsbarriere.com. This document precedes the acceptance by the Customer of these sales terms and conditions and the Customer entering their bank details for prepayment or a guarantee. Entering bank details implies acceptance of the booking confirmation by the Customer and has the effect of committing them contractually to the Barrière hotel booked.
"Customer": an individual acting exclusively for their personal needs.
"sales conditions at the time of booking": Price that applies to the date selected by the Customer for a category of room with or without breakfast, combined with payment terms and cancellation policy
"email": any message, comprised of text or imagery, sent via a public communication network, stored on a network server or in the recipient’s terminal, until the latter retrieves it.
"booking enquiry (or booking form)": booking enquiry for a room at a Barrière hotel, sent by the Customer via the website www.hotelsbarriere.com.
"online booking": room booking at one or more Barrière hotels through the website www.hotelsbarriere.com, via the electronic booking form,
"service": Barrière hotel room booking, the main features of which are shown on the website www.hotelsbarriere.com.
"website": electronic service run by Groupe Lucien Barrière on the internet and accessed via the following address: www.hotelsbarriere.com.

3. Purpose
1. These terms and conditions explain the rights and obligations of the parties in the context of the online booking of services offered by Barrière hotels on the Groupe Lucien Barrière website www.hôtelsbarriere.com.
2. They govern all the steps necessary to book and track the booking between the contracting parties.
3. The Customer acknowledges and accepts these sales terms and conditions and the sales conditions at the time of booking available on the site www.hotelsbarriere.com.

4. Duration
1. These sales terms and conditions apply for the full period that the Hôtels Barrière services are available on the www.hotelsbarriere.com website.
2. Groupe Lucien Barrière reserves the right to make changes to these sales terms and conditions, temporarily or definitively shut down the website www.hotelsbarriere.com or online booking area, without prior notice or compensation. To this effect, you are encouraged to consult them regularly.
3. Groupe Lucien Barrière is not responsible for damage of any kind that may result from these changes and/or temporary downtime or even the definitive shut down of all or part of the site or services associated with it, such as the online booking area.

5. Booking
1. The Customer selects services from among those offered by Hotels Barrière and presented on the website depending on their needs.
2. The Customer acknowledges the nature, location and booking conditions of services available on the website and having sought and obtained the necessary and/or additional details to make their booking in full knowledge of the facts.
3. As an individual, the Customer can reserve a maximum of three (3) rooms in total per booking on the www.hotelsbarriere.com website. If wishing to book more rooms, the Customer can request a call from the sales team by clicking on the link provided for this purpose at the foot of the web page.
4. The Customer is solely responsible for their choice of services and their appropriateness for their needs, such that neither Groupe Lucien Barrière nor the selected Barrière hotel can be held liable in this regard.
5. The reservation is deemed to have been accepted by the Customer at the end of the booking process.

6. Booking process
1. The booking carried out by the Customer is made by means of an electronic booking form accessed online via the website www.hotelsbarriere.com
2. The booking is deemed to have been completed on receipt by the Customer of their acknowledgement of receipt sent by the hotel.
3. Prior to any booking, the Customer commits to filling out the mandatory details requested as part of the booking form or enquiry.
4. The Customer certifies that the information supplied is true and accurate.
5. The booking procedure notably includes the following steps:
     Step 1. Searching for a hotel among the different Barrière hotels available on the website and choosing a room and sales conditions at the time of booking,
     Step 2 Selecting one or more supplementary services, if need be,
     Step 3 Checking the booking summary for the total price and sales conditions at the time of booking, which notably include payment terms and cancellation policy, changes if required to the choice of services (date, room, price, supplementary service),
     Step 4. Provision of Customer contact details,
     Step 5. Consultation and acceptance of the sales terms and conditions,
     Step 6. Entering of bank card details if guarantee or prepayment required,
     Step 7. Confirmation and Validation of the booking and payment by the Customer,
     Step 8. Customer receives acknowledgement of receipt for their booking. This acknowledgement of receipt summarises the contract offer, services booked, rates, sales conditions relating to the rate selected, accepted by the Customer, as well as the address of the retailer’s establishment, to which the Customer can address any complaints.

7. Cancellation or modification by the Customer
1. The Customer is reminded, in accordance with article L. 121-20-4 of the French Consumer Code, that they do not have the right of withdrawal referred to in article L. 121-20 of the French Consumer Code.
2. The Customer is also reminded that the sales conditions at the time of booking and accepted by the Customer detail the methods of cancelling and/or modifying the booking.
3. Prepaid bookings cannot be modified and/or cancelled. Amounts paid in advance constitute deposits and will not be refunded. This is mentioned in the sales conditions at the time of booking.
4. Where the sales conditions at the time of booking allow it:
• cancellation of the booking can be achieved immediately on the website www.hotelsbarriere.com through the "Your bookings" section;
• changes to the booking can be made with the Barrière hotel directly; phone numbers are provided on the acknowledgement of receipt from the Barrière hotel booked.
6. In the event that your stay is interrupted, the total amount for your stay will be charged. As for prepaid bookings, no refunds will be possible.
7. In the case of a no show, i.e. a booking that has not been cancelled, but for which the customer has not arrived at the Hotel at the beginning of their booking and when the booking has been confirmed by bank card, the Barrière hotel booked will debit the amount for one night, as compensation for loss suffered by the no show. If several nights were booked, the cancellation terms attached to the rate booked will apply.
8. Cancellation by the hotel: In the case of an exceptional event or inability to make the booked room available to the Customer, in the case of force majeure, the Barrière hotel booked will offer to accommodate the Customer at a hotel at least equivalent in standing, or if inferior, in a room superior to that originally booked, for similar services. All the potential extra costs attached to this displacement, for similar services, will be taken care of by the Barrière hotel originally booked, without paying any additional compensation.
9. All bookings are personal and can under no circumstances be transferred to a third party, with or without charge. All bookings made for others must be made in the name of the third party staying.

8. Staying at Hôtel Barrière
1. In accordance with current regulations in some countries, the Customer may be requested to fill out a form for the police on arrival at the Barrière hotel. For this purpose, the Customer will be asked to present some ID in order to verify whether or not they need to complete a form for the police.
2. Some Barrière hotels allow certain animals as long as they are kept on a lead or in a cage in all the common areas of the establishment (to check whether an establishment accepts animals or not, please see the hotel’s information sheet at www.hotelsbarriere.com). For reasons of hygiene, animals are not allowed in dining rooms.
3. The Customer accepts and commits themselves to using the room and the common areas at their disposal responsibly. Any behaviour that goes against security and/or hygiene guidelines, common decency and/or public order will result in the hotel manager asking the Customer to leave the establishment without compensation and/or a refund if payment has already been made.
4. Any damage caused by the Customer in the room that they booked will be invoiced directly. Fines equal to the maximum rate for the booked room will be applied if the Customer does not comply with signage banning them from smoking in their room, where signage appears. 
5. Some Barrière hotels have their own Internal Rules for Customers. The Customer accepts and commits to respecting said rules. In the event that the Customer fails to comply with one of the provisions of the Internal Rules, the hotel manager can ask the Customer to leave the establishment without compensation and/or a refund if payment has already been made.
6. Except as otherwise expressly provided, the Customer must leave the room by midday on the day their booking ends. Failing that, they will be invoiced for an additional night.

9. Guarantees
The Hotels are obliged to guarantee the conformity of services in the conditions laid down in articles L. 212-1 and s. of the French Consumer Code.

10. Liability
1. Photographs shown on the website are not contractual. Even if every effort is made to ensure that the photographs, graphics and texts used to illustrate the featured hotels give as accurate an overview as possible of the accommodation available, variations may occur, mainly due to changes in the furniture or possible refurbishment. The Customer cannot claim any compensation as a consequence.
2. In accordance with the laws and regulations governing intellectual property rights, the use and/or reproduction of all or some of the elements comprising the Barrière offers shown on the Website is strictly forbidden.
3. Groupe Lucien Barrière cannot be held liable for any indirect damage because of these terms and conditions, notably due to a third party, a Customer or Hôtels Barrière partners.
4. Hyperlinks can refer you to sites other than the Groupe Lucien Barrière site, which assumes no responsibility for the content of these sites or the services on offer. Groupe Lucien Barrière on one hand and Hôtels Barrière on the other have put in place measures to protect and secure their IT system against malicious acts. However, connection to the website and making a booking implies the Customer’s knowledge and acceptance of the nature and limitations of the Internet, as well as the fact that there exists no protection for certain types of data against possible misuse or hacking or against viruses that may be circulating on the network. Groupe Lucien Barrière on one hand and Hôtels Barrière on the other are not responsible in the event of improper usage or accidents relating to the use of computers or any support allowing access to the internet, maintenance or malfunction of the website or any other technical connection or the sending of information to an incorrect address.
5. Any booking or payment that is irregular, ineffective, incomplete or fraudulent due to the Customer will result in cancellation of the booking at the expense of the Customer, notwithstanding any civil or criminal action that may be taken against them.
6. In accordance with the booking of their stay, the Customer commits to behaving responsibly and not interfering in any way with the Hotel's team members or third parties at the Hotel. Such behaviour will result in the Customer being ejected from the Hotel without the Customer being able to claim any compensation at all.

11. Rates
1. Rates relating to the booking of services are given before and during booking.
2. Rates given apply per room, for the number of people and date/s selected.
3. Rates are confirmed to the Customer including tax, in the hotel's trading currency and are only valid for the duration given on the site.
4. If the Barrière hotel bill is paid in a currency other than that confirmed in the booking, the costs will be covered by the Customer.
5. All bookings, irrespective of their origin, are payable in the hotel's local currency, except where special special arrangements have been made on site at the hotel.
6. Foreign currency conversion is purely intended as an indication and non contractual. Only the currency confirmed at the time of booking is guaranteed (if this currency is different to that used by the hotel, any expenses will be covered by the Customer).
7. If a rate implies that payment is taken at the hotel, coinciding with the arrival or departure of the Customer and the currency of the Customer is not the same as that of the hotel, the rate debited by the hotel is likely to differ from that communicated at the time of the booking, taking into account potential change in exchange rates between the date of the booking and the dates of the stay at the hotel.
8. Unless otherwise specified, supplementary services (breakfast, half board, full board, etc.) are not included in the price.
9. Tourist tax, indicated for each rate, is payable on site directly to the hotel, except in the case of prepayment online where this cost may be included.
10. Rates include VAT applicable on the date the purchase was made and any change in the rate of VAT applicable will be automatically reflected in the rates indicated at the invoice date.
11. Any alteration or introduction of new legal or regulatory taxes imposed by the competent authority will be automatically reflected in the rates indicated as at the invoice date.
12. When confirming the booking by the Customer, the total purchase amount will be indicated.
13. Rates may be increased by different taxes, depending on the city/country. These taxes will be communicated to the Customer at the time of booking, provided that the Hotel is aware of them at the time. Failing that, they will be displayed in reception at the Barrière hotel booked. The Customer is committed to paying the different taxes without dispute at the Barrière hotel booked.
14. Hôtels Barrière guarantee that the best rates are available on the website www.hotelsbarriere.com. If the Customer finds another site offering a lower rate than that available on the site www.hotelsbarriere.com for an identical service, the Barrière hotel booked is committed to offering said preferential rate plus 10% discount. 12. Payment
1. Except for special conditions and rates, the Customer submits their bank details to confirm the booking by credit or debit card (Visa, Mastercard, American Express, Diners Club…) by entering the card number, without spaces between the numbers, as well as the expiry date (cards must be valid upon arrival) and the security code for prepayment in the area provided for this purpose (secured by SSL encryption), using the SOGENACTIF secure payment platform. On arrival day at the Hotel, the Customer must present the bank card with which they secured the booking or prepaid with. 
The Barrière hotel may also ask them to present some ID for the purposes of preventing credit card fraud.
2. Payment is taken at the hotel during the stay, except in the case of special conditions or rates when payment is taken at the time of booking (prepayment online for certain rates). This prepayment is considered to be a deposit. In the case of rates not prepaid online, the Barrière hotel can ask the Customer on arrival for a security deposit or authorisation to charge their credit card in order to guarantee the payment of sums corresponding to the benefits enjoyed on site.
3. Groupe Lucien Barrière and Hôtels Barrière have chosen a third-party provider (Payment Service Provider) in order to secure bank card payments online. The validity of the Customer’s payment card is verified by this provider. A payment card may be refused for various reasons: stolen card, blocked card, limit reached, PIN error… In the event that there is a problem, the Customer must firstly approach their bank, then the hotel, in order to confirm their booking and method of payment.
4. When prepayment is taken, the amount debited at the time of the booking includes: the price of the accommodation, taxes associated with the accommodation, the price for food service if breakfast was selected, taxes associated with the food service and any other supplementary services selected by the Customer, excluding tourist tax and/or any other tax that may be due as a result of the Customer staying at the hotel.

13. Personal data
1. Your personal data, collected in the context of your booking, specifically your title, surname, first name, postal address, telephone no. with country code, your email address, payment card references (number, card type, cardholder’s came, expiry date and security code) in the event that it is transmitted to us, as well as any data communicated via our website or generated by your navigation, constitute confidential data.
They are only accessible to Groupe Barrière companies and Groupe SFCMC companies, in addition to our sub-contractor responsible for managing our "bookings" pages, and are for the purpose of handling your bookings and stays and, provided that you accepted by ticking the corresponding box, sending you our newsletter, responding to your enquiries or communicating commercial offers. They are stored for the required duration of the commercial relationship between the Customer and Groupe Lucien Barrière and/or Hôtels Barrière.
Certain information, as requested on forms, is mandatory and marked by an asterisk. If you choose not to provide us with such information, we cannot process your request.
In accordance with French Data Protection Act no. 78-017 of 6 January 1978, you have the right to access, rectify and oppose the transmission of your personal data by writing to the Lucien Barrière Group, 35 Boulevard des Capucines, 75002 PARIS, France, Direction Marketing, or via e-mail to webmaster@lucienbarriere.com

2. In particular with online payment, the Customer’s bank details must be sent by the payment provider to the hotel’s bank in order to execute the contract for the hotel booking. The Customer is informed that this transfer of data may therefore take place in foreign countries without adequate personal data protection under the French Data Protection Act. However, the Customer consents to this transfer for the completion of their contract. As a professional, the provider has committed itself to Groupe Lucien Barrière to take all the security precautions and respect data confidentiality for said data transfers.

14. Convention of proof
1. Entering the required banking information, as well as the acceptance of these terms and conditions and the booking form or enquiry, constitute acceptance of the hotel contract between the parties, having the same value as a handwritten signature.
2. The computerised records saved on the computer systems belonging to Groupe Lucien Barrière will be kept in adequately secure conditions and considered as proof of the communications and payments between the parties.

16. Force majeure
Groupe Lucien Barrière and Barrière Hotels cannot be held responsible by the Customer in case of non-fulfilment of their obligations resulting from force majeure.
Likewise, the Customer cannot be held responsible by Groupe Lucien Barrière or Hôtels Barrière in case of non-fulfilment of their obligations resulting from force majeure. 
Those regarded as force majeure or fortuitous events are those usually recognised by the jurisprudence of French courts and tribunals.

17. Applicable law
1. These terms and conditions are governed by French law.
2. This applies to substantive rules as well as procedural rules.

18. Completeness
1. These Sales Terms and Conditions, the sales conditions at the time of booking by the Customer and the acceptance of the form or booking enquiry confirmation express all the obligations of the parties.
2. No general of specific condition communicated by the Customer may be included in these terms and conditions.
3. The documents forming contractual obligations between the parties are, in descending order of priority, the booking form or request (including the specific conditions for the rate booked) validated by the Customer and these terms and conditions.
4. In case of contradiction between the booking form and the terms and conditions, the provisions contained within the booking form confirmed and validated by the Customer and found in the acknowledgement of receipt from the Barrière hotel will be the only ones applicable to the obligation concerned.

19. Development/modification of the online Terms and Conditions
These Sales Terms and Conditions may be modified and/or updated by Groupe Lucien Barrière at any time. If so, the new version of the online Sales Terms and Conditions will be put on the internet by Groupe Lucien Barrière. As soon as they go online, the new version of the online Sales Terms and Conditions will automatically apply for all Customers.

20. Mediation
If the Customer has contacted customer service but not received a satisfactory response within 60 days, the Customer may refer the matter to the French Tourism and Travel Mediation group, whose contact details are as follows:
