Terms and Conditions of Use
The capitalized words have the meaning given to them in the Definition article or the terms of a clause herein.
1. Preamble
Lucien Barrière Group wished to allow its Employees to enjoy the Barrière experience within its Establishments at preferential rates as part of the Welcome Program.
Within the framework of this Program, the Barrière Group provides its Employees, under certain conditions, a defined number of offers at preferential Employee rates, per day and per establishment, within the scope of a dedicated inventory.
The benefits of this program are available through the dedicated booking Platform for BARRIERE Hotels, reserved for Employees and operated by Groupe Lucien Barrière. This Platform presents the BARRIERE Hotels operated by subsidiaries of Groupe Lucien Barrière participating in private offers and allows Employees to book stays in the participating BARRIERE Hotels.
2. Definitions
In these terms, the following terms will have the following meaning:
“Booking Summary”: a dematerialized document that summarizes the characteristics of the Services selected by the Employee on the Platform. This document precedes the Employee's submission of their banking information for prepayment purposes.
“Booking Confirmation”: a dematerialized document sent to the Employee to confirm the consideration of their booking, summarizing the characteristics of the Services booked by the Employee on the Platform and to which the current general terms and conditions of sale are attached.
“Employee”: a natural person acting solely for their personal and private needs, excluding any travel for professional reasons, and necessarily belonging to the staff of GLB or one of its French subsidiaries wholly owned, directly or indirectly, by GLB participating in the operation, or one of the Cannes subsidiaries of SFCMC, with service exceeding or equal to 6 months; only eligible Employees are designated for the Welcome Program.
“Terms of Sale for the Reserved Rate”: the price applied to the Employee, on the selected date by the Employee, for a room category with or without breakfast option, associated with its payment terms, reservation date change terms, or Services booked, and its cancellation terms, for a stay exclusively for personal and private reasons, excluding any travel for professional reasons or on behalf of a third party.
“Booking Request”: a request to book rooms, products, and/or Services in a BARRIERE Hotel made by the Employee.
“BARRIERE Hotel”: refers to a hotel establishment operated by a subsidiary of Groupe Lucien Barrière, eligible for the Employee Rate program according to the list of hotels referenced on the Platform and whose list is annexed to these clauses.
“Platform”: refers to the dedicated internet booking platform for BARRIERE Hotels, reserved for Employees, operated by Groupe Lucien Barrière and accessible at the following address: https://www.hotelsbarriere.com/fr/espace-collaborateur.html.
“Welcome Program”: special pricing offer provided by Groupe Lucien Barrière to its Employees under the present general sales conditions, among others.
“Service”: booking of rooms, products, and Services in a BARRIERE Hotel made by the Employee.
“Employee Rate”: preferential rate offered to Employees within the framework of the Welcome Program, subject to the availability of rates, rooms, and dates, among others.
3. Purpose
The purpose of these general terms and conditions is to:
define the terms and conditions under which the Barrière Group allows its Employees, within the Welcome Program, to benefit from preferential rates on room bookings in participating BARRIERE Hotels via the Platform;
define the rights and obligations of the Employee and the operating company of a BARRIERE Hotel for a booking via the Platform proposed by the BARRIERE Hotels;
define all the necessary steps for booking and tracking the reservation between the contracting parties.
4. Scope and Modifications of General Terms of Sale to Employees
To benefit from the Welcome program, the Employee must activate their dedicated private area on the Platform. By activating their area, the Employee acknowledges and accepts without reservation the current general terms of sale and also acknowledges and accepts that these prevail over the version of the general terms of sale they must accept at the time of finalizing their booking. Furthermore, the Employee agrees to regularly consult the current general terms of sale and, in any event, prior to each new booking they make. Their approval is deemed renewed with each booking made on the Platform.
Any booking made via the Platform implies the consultation and prior, complete, unconditional, and irrevocable acceptance of the rates offered on the Platform, of the present general terms, of the terms of sale of the rate attached to the room(s) they wish to book, as well as the applicable house rules; their acceptance is expressly manifested by the act of payment for their booking.
The Employee declares having the full legal capacity to commit themselves to these general terms and having met all the criteria of the “Employee” definition as specified below.
The Employee, prior to the booking, declares that this reservation is made for their personal needs. The Employee, in their status as a consumer, has specific rights, which would be compromised if the Services booked were not for personal purposes.
The Platform lists the following information:
the legal notice for precise identification of Groupe Lucien Barrière, indicating its corporate name, registered office, and individual VAT identification number,
the email address to contact Groupe Lucien Barrière,
the essential characteristics of the accommodations offered by BARRIERE Hotels,
the essential characteristics of additional and optional services offered,
the prices including all taxes,
the terms of sale of the reserved rate,
the payment terms,
the general terms of sale,
the validity period of the offers and their price.
All information provided on the Platform is in French.
The Employee can save and print the present general terms using the standard features of their browser or computer.
Groupe Lucien Barrière acting on behalf of its subsidiaries reserves the right to modify or supplement at any time all or part of these General Terms and Conditions of Sale. In this case, the new version of the general conditions will be available on the Platform with mention of its effective date. It is advised that the Collaborator regularly consults the general terms of sale to be aware of any potential changes. In any case, the Collaborator will only be bound by the version of the general terms and conditions in effect at the time the Collaborator makes and pays for the booking of their Service.
Groupe Lucien Barrière and/or its subsidiaries are not responsible for any damages of any nature that may result from these changes and/or a temporary unavailability or even the definitive closure of all or part of the Platform or the Services associated with it, such as the online booking space.
5. Booking
a) Access to the Platform
Precondition: To benefit from the Services offered to Collaborators, the Collaborator must create their account by connecting to the Platform, with their identifier (provided by Groupe Lucien Barrière) and choosing a password. The Collaborator is responsible for their identifier and password and undertakes to keep them confidential, not to communicate them to a third party in accordance with the rules set out in the internal regulations reserved for Collaborators.
b) Availability
Bookings are open all year round. However, during periods of high demand from our customers, there will be no rooms available for booking at the Collaborator rate.
The rates for a given room, for a given stay date, are subject to change depending on the date on which the booking is made.
The Collaborator rates are subject to a maximum inventory number per day and per hotel beyond which the rate will no longer be available.
c) Beneficiaries
Only Collaborators meeting the definition referred to in article 2 are eligible for the Welcome Program.
The Collaborator can only proceed with a booking at the Collaborator Rate if they are among the persons for whom the booking is made.
Any booking made by a Collaborator is nominative and cannot under any circumstances be transferred to a third party, whether free of charge or for remuneration.
If the Collaborator books an additional room, only family members will be authorized to stay in that room.
The Collaborator cannot bring third parties not known by the hotel into the room without the latter's authorization.
d) Booking
The Collaborator chooses Services from among those offered by BARRIÈRE Hotels according to their needs.
The Collaborator acknowledges having read the nature, price, destination, and reservation terms of the available Services and having requested and obtained necessary and/or additional information, notably the Sales Terms of the reserved rate, to make their booking with full knowledge of the facts.
The Collaborator may book, individually, a maximum of two (2) rooms per reservation on the Platform. The Collaborator is informed that the volume of rooms available at the Collaborator Rate is limited and subject to availability.
The Collaborator is solely responsible for their choice of Services and their suitability for their needs, so that Groupe Lucien Barrière, its subsidiaries, cannot be held liable in this regard.
The reservation is deemed accepted by the Collaborator at the end of the booking process, and upon communication of the credit card numbers in case of a guarantee or prepayment request.
6. Booking Process
1. The booking made by the Collaborator is done directly online on the Platform.
2. The booking request is confirmed upon the Collaborator's receipt of the Confirmation of reservation, sent by the concerned BARRIÈRE Hotel.
3. The Collaborator undertakes, prior to any booking, to complete the mandatory information required to create the reservation file.
4. The Collaborator attests to the truthfulness and accuracy of the information transmitted.
5. The booking procedure notably includes the following steps:
- Preliminary Step: At the time of connection, the Collaborator reads and accepts these general terms and conditions of sale.
- Step 1 - Search on the Platform for a Hotel among the different BARRIÈRE Hotels offered, choice of room, and reading of the Sales Terms of the reserved rate.
- Step 2 - Selection of the chosen room(s) and, if applicable, one or more additional services offered,
- Step 3 - Presentation of the booking summary, its total price, the Sales Terms of the reserved rate which notably include the payment conditions and the cancellation conditions, modifications if necessary of the service choices (date, room, rate, additional service), and information concerning the tourist tax,
- Step 4 - Communication of their contact details by the Collaborator,
- Step 5 - To finalize their "booking" step the Collaborator is required to accept the General Terms of Sale. However, it is recalled to the Collaborator that these General Terms of Sale are not enforceable. Only those accepted at the time of connection are valid for transactions made by the Platform.
- Step 6 - Communication of credit card numbers in case of a guarantee or prepayment request,
- Step 7 - Confirmation and Validation of the reservation and payment if applicable by the Collaborator. The entry of banking information signifies the Collaborator's acceptance and has the effect of contractually committing them to the selected BARRIÈRE Hotel.
- Step 8 - Receipt by the Collaborator of the email confirming their reservation. This email summarizes the booking date made, the Services booked, the prices including taxes with a breakdown of applicable taxes, the Sales Terms of the reserved rate (including cancellation conditions), accepted by the Collaborator, the general terms and conditions of sale as well as the address of the reserved BARRIÈRE Hotel.
If the confirmation email is not received within 24 hours following the Reservation, it is the Collaborator's responsibility to contact programme-bienvenue@groupebarriere.com to ensure the information provided and the reservation are taken into account. In the absence of an email, Groupe Barrière cannot be held responsible if the reservation was not taken into account.
It is specified that a Collaborator can only make reservations for stays taking place during the period of application of their employment contract within the Groupe BARRIÈRE. Otherwise, the reservation will be considered null and void.
7. Cancellation or modification by the Collaborator
1. The Collaborator is reminded, in accordance with article L. 221-28-12th of the Consumer Code, that they do not have the right of withdrawal provided for in article L. 221-18 of the Consumer Code.
2. The Sale Conditions of the reserved rate accepted by the Employee specify the terms of cancellation and/or modification of the reservation. Reservations with prepayment for a non-refundable and non-cancellable rate cannot be modified and/or canceled, except in cases of force majeure.
3. The interruption of stay, in the case of a reservation with prepayment for a non-refundable and non-cancellable rate, does not entitle to any refund except in cases of force majeure under the conditions of Article 16.
In the event of a 'no show', meaning in case of a prepaid reservation not canceled and for which the Employee did not represent themselves at Hôtel BARRIÈRE on the reserved day, Hôtel BARRIÈRE will not refund the prepayment amount. If multiple nights were reserved, no refund will be made to the Employee except in cases of force majeure under the conditions of Article 16.
4. When the Sale Conditions of the reserved rate allow it:
- the cancellation of a reservation made from the website hotelsbarriere.com can be done directly on the site through the 'Your Reservations' section, or with the selected Hôtel Barrière.
- In the event of a 'no show', meaning a reservation not canceled but for which the Employee did not appear at Hôtel Barrière on the reserved day and as long as the reservation was guaranteed by credit card or prepaid, the reserved Hôtel Barrière will charge, as compensation, the amount of one reserved night, or will not refund the prepayment amount. If multiple nights were reserved, the cancellation terms will apply according to the Sale Conditions of the reserved rate.
8. Cancellation by Hôtel
In the event of force majeure, the reserved Hôtel Barrière may offer the Employee an accommodation solution in a hotel of at least equivalent category or, if of a lower category, a room superior to that originally reserved, for services of the same nature. All possible additional costs associated with this relocation, for services of the same nature, will be assumed by the originally reserved Hôtel BARRIÈRE, without any other form of compensation.
In the event of a hotel BARRIERE reservation making the employee offer inoperable, by a seminar group or a leisure group which would have confirmed its visit, the reserved Hôtel Barrière may cancel the reservation of the Employee up to a maximum of 30 days before the Employee's arrival date. The Hôtel Barrière will immediately inform the Employee, and this cancellation will result in a full refund of the Employee's reservation, without any other form of compensation.
9. Stay at Hôtel Barrière
The rules applicable during the stay are notably included in the Internal Regulations of Hôtel BARRIÈRE, which the Employee is deemed to accept upon reservation.
1. Every person staying in a Hôtel BARRIERE must present valid identification at check-in. Failing this, Hôtel BARRIÈRE may refuse to rent them a room and/or cancel the reservation made without the possibility, if applicable, of a refund (this is not considered a cancellation by the Hôtel).
Employees of foreign nationality, including accompanying persons and adolescents over 15 years of age, must complete an 'individual police form'. Children under fifteen years of age may appear on an adult's form accompanying them. The information contained therein is governed by the 'code of entry and residence of foreigners and the right of asylum, article R.611-42'.
The Employee cannot introduce third parties to the room beyond those specified in the reservation without the express permission of Hôtel BARRIÈRE, who reserves the right to carry out all necessary checks.
2. When cats and dogs are allowed, they must, in any case, be kept on a leash in all common areas of the establishment. Hôtel BARRIÈRE may refuse to accommodate any pet or another animal likely to present a safety risk to other occupants, the assessment of this risk being left to the discretion of Hôtel BARRIÈRE. For hygiene reasons, animals are not admitted in dining areas (these provisions do not apply to guide dogs or assistance dogs). To ensure everyone's tranquility, animals should not be left unattended.
An additional charge per animal may be applied at the discretion of Hôtel BARRIÈRE.
3. The Employee accepts and undertakes to use the room and the common areas made available to them reasonably. Any behavior contrary to safety and/or hygiene principles, to good morals, and/or public order may lead Hôtel BARRIÈRE to ask the Employee to leave the establishment without refund.
4. Any damage caused by the Employee or by their occupants in the room or different spaces occupied during their stay must be reported to the Hotel reception or the Manager in charge, and may be directly charged to them based on the restoration expenses.
For safety reasons and out of respect for everyone, smoking is strictly prohibited on the Hotel premises. In accordance with the Public Health Code in its provisions setting the conditions for implementing the smoking ban in places intended for collective use, smoking in the Hotel exposes the Employee to the fine provided for third-class offenses or legal proceedings.
Penalties up to the maximum price of the reserved room may be applied if the Employee does not comply with the posting prescribing the ban on smoking in their room.
5. Les Hôtels Barrière have Internal Regulations intended for the Employee. The Employee accepts and undertakes to respect said regulations, whose provisions apply both to themselves and each of their accompanying persons during their stay. In the event of a violation of the provisions of said regulations, Hôtel BARRIÈRE may immediately expel the Employee and all the people sharing their stay, without any compensation and/or refund if a payment was already made. It may also refuse them any future reservation, as well as all the other Hôtels BARRIÈRE.
6. Unless expressly stated otherwise, the Employee must leave the room before 12:00 on the day of the end of the reservation. Failing this, they will be charged a late departure service or an additional night depending on their departure time from the room, according to the rules specific to each establishment.
10. Guarantees
Les Hôtels BARRIÈRE are bound by the guarantee of compliance of the Services, under the conditions laid down in Articles L. 212-1 and seq. of the Consumer Code.
11. Liability
1. The photographs presented on the Platform or any other medium are not contractual. Even though every effort is made for the photographs, graphic representations, and texts reproduced to illustrate the presented Hotels to give an accurate overview of the offered accommodation services, variations may occur, especially due to furniture changes or possible renovations. The Collaborator cannot claim any complaint because of this.
2. In accordance with the laws and regulations governing intellectual property rights, the use and/or reproduction of all or part of the elements constituting the Barrière offers present on the Platform is strictly prohibited, as is any reproduction of the scenery and/or characteristic elements of the BARRIERE Hotels.
To respect the privacy and image rights of other clients, the Collaborator refrains from photographing them within the premises of the BARRIERE Hotel or its dependencies and/or from publishing photographs taken under such conditions.
3. Groupe Lucien Barrière is not liable for any direct or indirect damage resulting from the actions of a third party, the Collaborator, or the partners of the BARRIERE Hotels.
4. Hyperlinks may refer to other sites than the Reservation Platform of Groupe Lucien Barrière, which disclaims all responsibility for the content of these sites and the Services offered. Groupe Lucien Barrière on one hand and the Barrière Hotels on the other hand have implemented protection and security measures for their information system against acts of malice, however, connecting to the Platform and making a reservation implies for the Collaborator, the knowledge and acceptance of the characteristics and limitations of the Internet, the lack of protection of certain data against possible misappropriations or hacking or risks of contamination by possible viruses circulating on the network. Groupe Lucien Barrière and the BARRIERE Hotels disclaim all responsibility in the event of misuse or incident related to the use of the computer or any medium that allows access to the Internet, the maintenance or malfunction of the Platform, or any other technical connection and the sending of information to an incorrect address.
5. Any reservation or payment that is irregular, inoperative, incomplete, or fraudulent for a reason attributable to the Collaborator will result in the cancellation of the order at the expense of the Collaborator, without prejudice to any civil or criminal action against the latter.
6. The Barrière Hotels reserve the right not to receive or to expel, without refund, Collaborators whose attire is indecent and neglected, whose attire is intended to conceal the face (Law No.2010-1192 of October 11, 2010), Collaborators with loud, improper, or intoxicated behavior, Collaborators whose behavior is contrary to hygiene, good manners, and public order. Decent attire is required in the restaurants and public areas of the Hotel.
The Collaborator is courteous and respectful towards the Hotel staff. Under pain of exclusion without refund, the Collaborator refrains from any verbal or physical violence, any racist behavior or remarks, as well as any form of harassment.
12. Prices
1. The prices related to the reservation of the Services are communicated before and during the reservation.
2. The communicated prices are understood per room for the number of person(s) and the selected date(s). Unless otherwise stated, additional Services (breakfast, half board, full board…) are not included in the price. Upon confirmation of the Collaborator's reservation, the total amount of the reservation of Services will be indicated.
The prices take into account the VAT applicable on the day of booking and any change in the applicable VAT rate will be automatically reflected in the prices indicated at the billing date.
3. Prices are confirmed to the Collaborator including all taxes (TTC), in the commercial currency of the Hotel (Euro), which in some cases may be different from the local currency of the establishment. The communicated prices are only valid for a limited period. All reservations are payable in the hotel's local currency.
4. The tourist tax and any other taxes specific to the municipalities indicated for each rate are not included in the price and must be paid directly on-site at the Hotel unless in the case of online prepayment, where this amount may be included.
5. Any modification or establishment of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices indicated on the billing date. Indeed, rates may be increased by different taxes depending on the cities/countries. These taxes will be communicated to the Collaborator at the time of reservation, if they are known to the Hotel at that time. Otherwise, they will be displayed at the reception of the reserved BARRIERE Hotel. The Collaborator agrees to pay the various taxes, without any objection to the reserved Barrière Hotel.
13. Payment
1. The Collaborator provides their payment data either (i) to prepay the reservation before the stay, or (ii) as a guarantee for the reservation in case of a "no show". When it comes to a credit card, the required information is: the credit card number, without spaces between the numbers, the expiration date (it is specified that the credit card used must be valid at the time of the stay), and the visual cryptogram in the context of a prepayment.
The Barrière Hotels have chosen A.T.O.S (i.e., Payment Service Provider) to secure online prepayments by credit card using 3D Secure. The Collaborator's payment card is subject to security checks (credit control, card country control, IP address country control, etc.) by the designated partner and may be refused for several reasons: stolen or blocked card, limit reached, input error, etc. In case of a problem, the Collaborator must contact their bank on the one hand, and the BARRIERE Hotel or any other entity, on the other hand, to confirm their Service reservation and payment method.
The available and communicated online payment methods may be Visa and Mastercard cards, American Express, etc. This list is subject to change.
2. Payment processing takes place at the Barrière Hotel during the stay, except in the case of special conditions or rates where payment processing takes place at the time of booking (prepayment on certain rates).
3. In the case of payment at the Barrière Hotel, each Barrière Hotel may accept different means of payment, but the Collaborator must present the credit card used to guarantee the reservation or make the prepayment to ensure the identity of the Collaborator. The BARRIERE Hotel may also ask them to present an ID document for the prevention of credit card fraud.
If the Employee has not prepaid for their stay, the Establishment will request a security deposit or authorization to debit the bank card upon arrival to guarantee the stay corresponding to the total amount of reserved nights increased by a fixed amount of 75 euros per room per night to guarantee extras. This same guarantee will be required from invited third parties.
If the Employee has prepaid for their stay, Hotel BARRIERE may request a flat fee of 75 euros per room per night to guarantee extras.
For remote sales made by phone, the Employee is informed that they must sign the receipt upon arrival at Hotel BARRIERE.
4. In case of no show, meaning in the case of a reservation not canceled but for which the Employee did not show up at Hotel BARRIERE on the reserved day and provided that the reservation was guaranteed by bank card, Hotel BARRIERE incurs the cost of the no show. If several nights were reserved, the cancellation terms attached to the reserved rate will apply.
5. At the time of prepayment, the amount debited during the reservation includes: the price of accommodation, the taxes related to accommodation, the price of dining if breakfast is chosen, the taxes related to dining, and any other additional services selected by the Employee excluding tourist tax and/or any other tax that would be due due to the Employee's stay at Hotel BARRIERE.
14. Personal Data
1. Your personal data requested in connection with your reservation, namely your title, last name, first name, your postal address, your phone number with country code, your email address, your payment card references (Number, card type, cardholder name, expiration date, and cryptogram in case we are provided with it) as well as any data communicated or generated by your navigation constitutes confidential data.
2. The data collected is intended for the establishments, subsidiaries or managed entities of Groupe Lucien Barrière SA or the Société Fermière du Casino Municipal de Cannes (SFCMC) concerned, as well as our subcontractor in charge of managing our "reservations" pages and is for the purpose of processing your reservations and stays. They will also be used to send you offers and communications from the Group based on our legitimate interest in promoting similar products and services. You have the option to object at any time via the link present in the communication campaigns or now by contacting us at the email address dpo@groupebarriere.com.
We may also be led to conduct studies (of satisfaction or statistics) based on our legitimate interest in improving our services.
3. Certain information requested in the forms is mandatory and is indicated by an asterisk. If you choose not to provide it, we will not be able to process your reservation request.
4. In accordance with the "Informatique et Libertés" law of January 6, 1978, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, regarding the protection of individuals concerning the processing of personal data and the free movement of this data, you have, among other things, the right of access, rectification, erasure, and to request a limitation on the processing of personal data relating to you.
You also have the right to object to the processing of your data for legitimate reasons and the right to object to the processing of your data for commercial prospecting purposes, as well as the right to give us directives on the fate of your data after your death.
You also have the right to lodge a complaint with the competent supervisory authority (in France, the National Commission for Informatics and Liberties, or "CNIL").

5. When the processing of your personal data implies a transfer within a country located within the European Union or outside, and providing a level of protection equivalent to that of the GDPR, these transfers are necessarily carried out in exchange for appropriate guarantees.
When the sharing of this information implies a transfer to a State offering a different level of data protection than that offered within the European Union, we commit to using the European Commission's standard contractual clauses.

In accordance with applicable regulations and to respect business secrecy and the confidentiality obligations to which we are bound, some information may be redacted.
In particular, during online payment, the Employee's bank details must be transmitted by the payment provider to the Hotel's bank, for the execution of the hotel booking contract.
The Employee consents to this transfer for the execution of their contract.
15. Information on the BLOCTEL system

16. Evidence Agreement
1. The entry of the required banking information, as well as the acceptance of these general conditions and the voucher or reservation request, constitutes acceptance of the Hospitality contract, between the parties, having the same value as a handwritten signature.
2. The computerized records kept in the IT systems of Groupe Lucien Barrière will be kept under reasonable security conditions and considered as proof of communications, orders, and payments made between the parties.
17. Force Majeure
Groupe Lucien Barrière and its subsidiaries cannot be held liable to the Employee in case of non-performance of its obligations resulting from an event of force majeure.
Similarly, the Employee cannot be held liable to Groupe Lucien Barrière and its subsidiaries, in case of non-performance of its obligations resulting from an event of force majeure.
Events considered as cases of force majeure or fortuitous events are those usually recognized by the jurisprudence of French Courts and Tribunals.
The reserved Barrière Hotel may offer the Employee an accommodation solution in a Hotel of at least equivalent category or, if it is of a lower category, a room of a higher level than the one originally reserved, for services of the same nature. Any potential additional costs related to this relocation, for services of the same nature, will be covered by the originally reserved Barrière Hotel.
18. Applicable Law
These General Terms and Conditions of Sale are governed by French law. This applies to both substantive and procedural rules.
19. Entirety
1. These General Terms and Conditions of Sale, the sales conditions of the rate reserved by the Collaborator, and the booking confirmation express the entirety of the parties' obligations.
2. No general or specific conditions communicated by the Collaborator can be integrated into these general conditions.
3. The documents forming the contractual commitments between the parties are, in descending order of priority, the booking order or request (including the specific conditions of the reserved rate) validated by the Collaborator and these general conditions.
4. In case of contradiction between the booking confirmation and these general conditions, the provisions on the booking confirmation will be the only applicable ones for the obligation in question.
20. Mediation
1. The collaborator is informed by GROUPE BARRIERE of the possibility of resorting, in case of dispute relating to these general conditions, to a conventional mediation procedure or any other alternative dispute resolution method, under the conditions provided in Title I of Book VI of the Consumer Code.
2. After contacting the customer service or hotel to try to resolve the dispute amicably, and in case of a negative response or no response within a period of sixty (60) days from the contact, the collaborator may approach the Tourism and Travel Mediator if he/she believes it necessary to contest the hotelier's decision by contacting Tourism and Travel Mediation at BP 80303, 75823 Paris Cedex 17 – info@mtv.travel – www.mtv.travel. The contact with the Mediator can be made within a period of twelve (12) months after the first claim.
3. GROUPE BARRIÈRE also informs the collaborator of the existence of a European Online Dispute Resolution Platform ('ODR') which he/she can access via the following link: http://ec.europa.eu/consumers/odr/.
